By checking "I agree to the Terms of Use", you certify that any content that you upload to the Zemirot Database is either your own original work, work that you are allowed to post on the Zemirot Database, or content that is in the public domain.
UNLESS THE WORK YOU POST IS IN THE PUBLIC DOMAIN, YOU MUST OWN THE RIGHTS TO POST THE WORK OR BE LICENSED TO POST THE WORK. When you upload content, you license that content to the owner of the Zemirot Database (if it is not already in the public domain or freely licensed), permitting the Zemirot Database to display the content on the website, modify the content, erase the content, or sublicense the content to others. You also permit other users of the Zemirot Database to modify or erase the content. You agree that the work may be further used as discussed in these Terms and in the Copyright Policy. By agreeing to these Terms, you certify that you have the ability to grant this license. All content uploaded, including recordings, must be your original creation or work that you are allowed to distribute. By uploading content, you certify that you have permission to upload the content to the Zemirot Database. You further certify that display of the content on the Zemirot Database, or use of the content as discussed in these Terms or the Copyright Policy, will not infringe copyrights. There are generally three separate copyrights that attach to a sound recording: a copyright in the lyrics, a copyright in the tune, and a copyright in the recording itself. In order to post a recording, each of these rights must either be owned by you, licensed by you in such a way that permits you to post the tune, or be in the public domain. The supervisors of the Zemirot Database may remove any content that appears not to fit the above criteria. The supervisors will also respond promptly to requests to take down material, which may be made pursuant to our Digital Millennium Copyright Act Policy. The DMCA Policy describes the information that must be included in takedown notices as well as the response of the Zemirot Database to takedown notices. If you upload content and do not identify the creator of the content, you agree that this content may be reproduced or altered by anybody for any purpose, to the extent permitted by law, provided that the Zemirot Database is credited. If you upload content and identify the creator of the work such that the creator's name is visible on the "View Song" page, you agree that this work may be reproduced or altered for any purpose, as permitted in the Copyright Policy, to the extent permitted by law, provided that the creator of the work is credited along with the Zemirot Database. The Zemirot Database disclaims any responsibility for liability that users incur resulting from use of content on the Zemirot Database. Users should make their own determinations of the copyright status of content before distributing content. Embedding or hotlinking audio files from the Zemirot Database on other websites is forbidden. Please contact us to request permission. THE SUPERVISORS OF THE ZEMIROT DATABASE WILL DELETE THE ACCOUNTS AND BLOCK THE IP ADDRESSES OF USERS WHO REPEATEDLY VIOLATE THESE TERMS. Pursuant to the repeat infringer policy requirements of the Digital Millennium Copyright Act, we maintain a list of DMCA notices from copyright holders and make a good faith effort to identify any repeat infringers. It is not a corporation or a business entity. The website generates no revenue. It is a website run as a hobby by its supervisors. The supervisors are not paid and do not make any money from the Zemirot Database's operation. |
